Terms of Service
Thank you for purchasing a Choice Home Warranty (“CHW”) Home Protection Plan. Subject to these terms of service, Your Home Protection Plan is eligible to receive one (1) year of home title monitoring & identity theft protection (“Financial Shield”) from Intersections, LLC d/b/a Pango (“Pango”) without additional charge.
Disclaimer
This Disclaimer serves to inform our valued customers that CHW is providing you access to Financial Shield, which is offered by a third-party-provider. Please carefully read and understand the following information:
- Third-Party Service: Choice Home Warranty is not directly responsible for providing Financial Shield. We have partnered with a reputable third-party company to offer this service to our customers. Pango, the third-party provider, is solely responsible for the provision, management, and monitoring of Financial Shield.
- Limited Liability: While CHW facilitates access to Financial Shield, we do not assume any liability for the accuracy, reliability, or completeness of the information provided through this service. Any claims, disputes, or issues arising from the use of Financial Shield should be directed to Pango.
- Independence of Service: Please note that Financial Shield is provided by Pango and is independent of the home warranty coverage provided by CHW. These services are separate and distinct, and the existence of the Financial Shield product does not affect the terms and conditions of your home protection plan with CHW.
- Disclaimer of Endorsement: CHW does not endorse, recommend, or guarantee Financial Shield. The decision to utilize Financial Shield is solely at the discretion and responsibility of you, the customer.
- Modification or Termination: Choice Home Warranty reserves the right to modify, suspend, or terminate the access to Financial Shield at any time without prior notice. In such cases, CHW shall not be liable for any inconvenience, loss, or damages incurred by the customer resulting from the modification or termination of the service.
By utilizing Financial Shield, you acknowledge and accept the terms outlined in this disclaimer. It is your responsibility to review and understand the terms before making use of Financial Shield provided by Pango.
Activation Requirement
To receive Financial Shield, You are required you to activate Financial Shield with Pango, Financial Shield is subject to detailed terms and conditions, which will be provided by Pango.
How to Activate
Pango will send You an e-mail with the subject line: “Welcome to Financial Shield” that includes a link to set your password.
- In order to receive Financial Shield, You are required to select the link in the Pango e-mail and set Your password. Once you have successfully set your password you will gain access to Financial Shield and your activation is complete.
- You must complete the Financial Shield activation within one hundred and eighty (180) days of Your Home Protection Plan Start Date or You will no longer be eligible for complimentary Financial Shield.
Complimentary Term
- Start Date: The free Financial Shield begins on the later of Your Home Protection Plan start date or the date You complete Your activation with Pango.
- End Date: One (1) year after Your Home Protection Plan start date.
After The Complementary One (1) Year Term. You will be provided the opportunity to renew Financial Shield.
Assignment
These Terms, and any rights and license granted hereunder, may not be transferred or assigned by You but may be assigned by Us without restriction. Any assignment attempted to be made in violation of these Terms shall be void.
Entire Agreement
These Terms (including any documents incorporated here by reference) constitute the entire agreement between You and Us concerning its subject matter, and it supersedes any other prior or contemporaneous agreements or terms, written or oral.
Force Majeure
Neither Us nor You will be liable for inadequate performance under these Terms to the extent caused by events beyond the reasonable control of a party, which may include denial-of-service attacks, internet disturbance, strikes, riots, pandemics or epidemics, natural disasters, acts of God, war, terrorism, and governmental action.
Governing Law
These Terms will be governed by and construed by the laws of the State of New Jersey, USA, exclusive of its choice of law principles.
Interpretation
These Terms were prepared and written in English. Any non-English translations of these Terms which may be made available are provided for convenience only and are not valid or legally binding. Use of section headings in these Terms is for convenience only and will not have any impact on the interpretation of particular provisions. The use of the words “includes,” “including,” “such as,” “for example,” and similar terms are deemed not to limit what else might be included.
Severability
If any provision of these Terms is held to be unlawful, void, or for any reason is unenforceable, then that provision will be limited or eliminated from these Terms to the minimum extent necessary and will not affect the validity and enforceability of any remaining provisions.
Third Party Beneficiaries
Except as expressly provided herein, there will be no third-party beneficiaries to these Terms.
